Giveaway Rules

These rules apply to the 2020 Amazon.com Gift Card giveaway conducted by Visit Buffalo Niagara (VBN).

Who can enter

To enter, applicants must be 18 years of age or older. VBN reserves the right to examine identification and may reasonably choose to accept or deny awarding the prize based on identification presented.

Employees (including without limitation, part-time or temporary employees) of VBN, VBN Foundation and all affiliated companies at anytime during the applicable period and the immediate family and household members of each of the above are NOT eligible to enter and/or to win the Giveaway.

Applicant may only win one prize per giveaway, unless expressly specified otherwise in giveaway rules for the specific giveaway at issue.

Entry/Winning

No purchase is necessary to enter or win. Entries must be received by February 14, 2020.

VBN is not responsible for any technical difficulties experienced due to overload, busy signals, loss of phone service, electronic problems or any other factor that may prevent an individual from completing a phone call, receiving a fax, receiving an e-mail or for any technical malfunction related to any telephone connection, servers, routers or any other technical problem that may impact entry, participation or prize claim.

All entries become the property of VBN and will not be acknowledged or returned. Entries received that are tampered with, illegible or from ineligible entrants will be void. Entries that are determined to be fraudulent will be void, and the person making such an entry barred from further participation in the giveaway. Incomplete entries may be disqualified at VBN discretion.

For internet based entries (whether via email entries, online submissions of entries or via websites), entrants will be asked to go to a particular website at particular times to enter the giveaway. Criteria for winning and/or conditions for entry will be announced on the website. Winners will be selected in accordance with criteria set forth on-line with respect to the giveaway.

The giveaway requires VBN to notify winner since there is a deadline for prize claims, if VBN does not have actual contact with the winner as part of the giveaway, VBN will be required to leave one message at the number provided in the entry form or provided at the time VBN collected the winner’s information. If no answer or voicemail is reached, VBN will not be obligated to attempt any further contact. However, VBN reserves the right, in its sole discretion, to attempt to contact any winner more than once and shall not be required to attempt to contact all winners/applicants an equal number of times.

Prize

Notwithstanding anything to the contrary herein or stated, no person will be entitled to receive any prize until after their eligibility has been confirmed or accepted by VBN and all required paperwork ( including without limitation, liability release, agreements) have been completed by the pending winner.

Prizes will be released to winners only. Winners may be required to sign a Liability Release Agreement relieving VBN, VBN Foundation and any affiliated organizations from any and all liability with respect to the applicant’s participation in the giveaway and the receipt and/or use of the prize. Any person refusing to sign the Release and/or provide a tax identification number or complete or provide any other documents required by VBN by the deadline required by VBN will forfeit any and all giveaway prizes.

Prizes not claimed within thirty (30) business days of being awarded, or in the case of a time sensitive prize, within its period of usability, shall be considered forfeited and will become property of VBN. Such prize may be disposed of at the discretion of VBN Management.

Winners are responsible for paying all applicable local, county, state, federal and provincial taxes on prizes based on the estimated retail value of the prize, as set forth in the giveaway rules, and will be issued an IRS 1099 form for all prizes won from VBN where the aggregate value of all prizes is $ 600 or more.

With respect to travel and/or event tickets of any kind, VBN and sponsors are not responsible for replacing or reimbursing winners with any form of compensation for flights or events that are canceled, rescheduled or delayed. All cancellations are deemed beyond the control of VBN and its sponsors. This includes but is not limited to, event cancellations, trip schedule changes, flight cancellations, changes in travel arrangements, travel delays of any form and duration, as well as all delays or cancellations due to acts of nature, terrorism, illness or war. Additionally VBN is not responsible for any expenses incurred by giveaway winners as a result of such cancellations or delays.

Miscellaneous

Odds of winning depend on number of entries received. Gift card awards are limited to the first 100 entries.

VBN will be the sole arbiter in all matters relating to the giveaway and the interpretation of giveaway rules. Their decisions shall be final. Entry into the giveaway constitutes agreement by applicants to abide by these rules, as well as any other rules established by VBN.

By participating in a VBN giveaway, entrants hereby agree that VBN and its affiliates has no, and hereby release VBN and affiliates and its giveaway sponsors from responsibility or liability in connection with any injuries, losses or damages of any kind/caused by or resulting from the acceptance, possession and/or use of a prize or an entrant’s participation in such giveaway.

By participating in a VBN giveaway, entrants hereby consents to VBN and giveaway sponsors’ usage of any one or more of the following for any other advertising or promotional purpose with out payment of any additional consideration: applicants name; voice; likeness; biographical information; his/her participation in the giveaway; and the substance of the applicant’s telephone call.

VBN giveaways are subject to all applicable laws and regulations and are void where prohibited.

VBN reserves the right to terminate or declare any giveaway null and void and rescind any prize, if in its sole judgment, the rules or the integrity of the giveaway have been violated or compromised in any way. Intentionally or non intentionally by any person whether or not a applicant in the giveaway.

Winner’s List: For a list of winners mail a self addressed stamped envelope to the VBN address below, identifying the name of this giveaway.
